Description

NHS England South West (South) is anticipating issuing a procurement for the Provision of Offender Personality Disorder services to HMP Channings Wood in March 2019, for a service commencement date of July 2019. The contract will be for an initial term of 27 months, with an option to extend for a further 24 months at the sole discretion of the Commissioner. Payment will be made on a staged basis and the maximum total value of the contract, including any extension, is £2,030,000.

As part of the procurement process, the Commissioner will be holding a bidder event on the morning of 21st March in Newton Abbot, Devon. The purpose of this event is to enable bidders to hear from Commissioners regarding the objectives of the procurement, the current services context and the procurement process being followed.

This service is commissioned as a part of the Offender Personality Disorder (OPD) pathway. The four high level outcomes for the OPD pathway are:
• For men, a reduction in repeat serious sexual and/or violent offending; or for women, a reduction in repeat offending of specified offences;
• Improved psychological health, wellbeing, pro-social behaviour and relational outcomes;
• Improved competence, confidence and attitudes of staff working with complex people who are likely to have severe 'personality disorder';
• Increased efficiency, cost effectiveness and quality of OPD pathway services.

In order to access the bidder event and express an interest you will need to register on the In-Tend portal and send your organisation details along with the names of no more than 3 attendees to Phil Fear, via the e-procurement messaging system, by no later than 12 noon on Monday 18th March 2019. On expression of interest, you will be sent details regarding the venue and timings for the day via the e-procurement messaging system.

Please note that all presentation slides from the day as well as any clarification questions and responses will be made available to all of those that have expressed interest in the event.

The services are healthcare services falling within Schedule 3 to the Public Contracts Regulations 2015 ("the Regulations") which are not subject to the full regime of the Regulations, but is instead governed by the "Light Touch Regime" contained within Chapter 3, Section 7 of the Regulations (Regulations 74 to 77).

The tendering process will be conducted in accordance with the requirements and flexibilities provided by Articles 74 to 76 of the Directive, and Regulations 74 to 76 of the Regulations. The Authority will run a transparent tender process, treating all Bidders equally. For the avoidance of doubt, the Authority will not be bound by the Regulations or the Treaty on the Functioning of the European Union or any other regulations or legislation except for the specific parts or circumstances that apply to the procurement of these Services.

Neither the inclusion of a Bidder selection stage, nor the use of any language or terms found in the Directive or Regulations, nor the description of the procedure voluntarily adopted by the Authority ("Open", "Restricted", "Competitive Procedure with Negotiation", "Competitive Dialogue" or any other description), nor any other indication, shall be taken to mean that the Authority intends to hold itself bound by the Directive or Regulations, save by the provisions applicable to services coming within the scope of Annex XIV of the Directive / Schedule 3 of the Regulations.

The Contracting Authority intends to voluntarily observe the award decision notices provisions and 10 day standstill period described in Regulation 86 of the Regulations. Unsuccessful Bidders will receive scores and reasons for the decision, including the characteristics and relative advantages of the winning bid and the reasons why the Bidder/application was unsuccessful. Deadline for lodging of appeals should be in accordance with Regulation 87 and Regulation 91 of the Regulations.
