Description
The Land Combat Vehicles 1 Team, part of the United Kingdom Ministry of Defence (the MoD), intends to award a Challenger Armoured Repair and Recovery Vehicle ('CRARRV') Brake Light System Development contract to Rheinmetall BAE Systems Land Limited (RBSL) for modification of the CRARRV platform design to accommodate brake light systems, trials, and delivery of brake light systems for installation by MoD personnel.
The contract will be for two years and have an estimated value of £1,660,636.94, excluding VAT.
As this procurement commenced prior to 24 February 2025, it continues to be regulated by the Defence and Security Public Contracts Regulations 2011 in accordance with regulation 3(c) of The Procurement Act 2023 (Commencement No 3 and Transitional and Saving Provisions) Regulations 2024.
In accordance with Regulation 4 of the Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this contract falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the official Journal of the European Union is no longer appropriate. It is considered that the award of contract without prior publication of a contract notice in the UK e-notification service (as required by the relevant legislation) is lawful in accordance with regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 for technical reasons.
This is because RBSL is the original equipment manufacturer of the platform needing modification. RBSL is the only economic operator with the essential platform technical data and design familiarity to assure platform safety and continued capability effectiveness post adaptation.
