Description

NHS England Specialised Commissioning (South) is responsible for the provision of satellite haemodialysis operational services to 3 existing haemodialysis units at Taunton, Yeovil and Frome. In addition, the commissioner would like to explore the opportunity of further sites at Bridgwater and Bath. The procurement is split in to three lots:
-Lot 1 Taunton (& Bridgwater)
-Lot 2 Yeovil
-Lot 3 Frome (& Bath)

Initial contract duration for each Lot is 48 months and the total annual value : £5523336-6152328

Bidders should note that award of the Bridgwater and Bath elements of Lots 1 & 3 are optional and at the sole discretion of the Commissioner, as further described in the procurement documentation. Each Site is supported by a Supervising Trust

The contract for each of the lots will be held by NHS England as the contracting authority, but bidders should note the possibility of the contract(s) being novated to the relevant Supervising Trust during the contract term, as further described in the procurement documentation.

Lot 1
Contract value: £1729728-£235872PA.
Supervising Trust: Royal Devon and Exeter NHS Trust. Bidders will need to ensure they are able to provide dialysis treatment in the unit they are bidding for, in accordance with the specification and that all necessary supplies and support services for dialysis provision, including signposting to relevant Trust and GP support services, are provided.

The commissioner would like to explore the opportunity of a further site at Bridgwater, as further described in the procurement documentation.

Lot 2
Contract value: £1277640PA.
Supervising Trust: Dorset County Hospital NHS Foundation Trust. Bidders will need to ensure they are able to provide dialysis treatment in the unit they are bidding for, in accordance with the specification and that all necessary supplies and support services for dialysis provision, including signposting to relevant Trust and GP support services, are provided.

Lot 3
Contract value:£943488-£2515968PA.
Supervising Trust: North Bristol NHS Trust. Bidders will need to ensure they are able to provide dialysis treatment in the unit they are bidding for, in accordance with the specification and that all necessary supplies and support services for dialysis provision, including signposting to relevant Trust and GP support services, are provided.

The resulting contract for each of the lots will be held by NHS England as the contracting authority, bidders should note the possibility of the contract(s) being novated to the relevant Supervising Trust during the contract term, as further described in the procurement documentation. In bidding for any of the Lots listed in this procurement, Bidders accept and agree that the relevant contract may be novated away from NHS England and to the relevant Supervising Trust during the contract term. Any such novation will be against the existing terms of the contract, and in line with Regulation 72 of the Public Contracts Regulations

The services are healthcare services falling within Schedule 3 to the Public Contracts Regulations 2015 ("the Regulations") which are not subject to the full regime of the Regulations, but is instead governed by the "Light Touch Regime" contained within Chapter 3, Section 7 of the Regulations (Regulations 74 to 77).

The tendering process will be conducted in accordance with the requirements and flexibilities provided by Articles 74 to 76 of the Directive, and Regulations 74 to 76 of the Regulations. The Authority will run a transparent tender process, treating all Bidders equally. For the avoidance of doubt, the Authority will not be bound by the Regulations or the Treaty on the Functioning of the European Union or any other regulations or legislation except for the specific parts or circumstances that apply to the procurement of these Services.

Neither the inclusion of a Bidder selection stage, nor the use of any language or terms found in the Directive or Regulations, nor the description of the procedure voluntarily adopted by the Authority ("Open", "Restricted", "Competitive Procedure with Negotiation", "Competitive Dialogue" or any other description), nor any other indication, shall be taken to mean that the Authority intends to hold itself bound by the Directive or Regulations, save by the provisions applicable to services coming within the scope of Annex XIV of the Directive / Schedule 3 of the Regulations.

The Contracting Authority intends to voluntarily observe the award decision notices provisions and 10 day standstill period described in Regulation 86 of the Regulations. Unsuccessful Bidders will receive scores and reasons for the decision, including the characteristics and relative advantages of the winning bid and the reasons why the Bidder/application was unsuccessful. Deadline for lodging of appeals should be in accordance with Regulation 87 and Regulation 91 of the Regulations.
