Description
The Authority is seeking to procure a Mental Health Treatment Requirement Service (MHTR), that will provide a sentencing option for individuals who have low-moderate needs in relation to their mental health. This service is for individuals whose offence crosses the community order sentencing threshold and who have pleaded guilty or been found guilty of an offence following a trial.
The individuals will present with a range of mental health issues including but not limited to: personality disorders, dual diagnosis, history of trauma and abuse, and will be assessed as to suitability for MHTR and where an MHTR is imposed (including as part of a Community Sentence Treatment Requirement) an intervention will be provided. It is noted that there is an increased prevalence of individuals with neurodivergent needs within the criminal justice system and so it is likely there will be an increased prevalence within the cohort sentenced to an MHTR. With this in mind, a neurodivergent aware service will be key.
Based on the Treatment Requirement (TR) early data, the number of MHTRs sentenced to (within a population size of 300,000) is in the region of 80 per annum. This figure is dependent on population and levels of deprivation and other factors.
Treatment requirements bring together the resources and skills to help those with mental health and substance misuse difficulties. Consent is required for all treatment requirements. The Requirement must be expressed in months and in agreement with the treatment providers.
If sentenced to a combined order (overseen by the allocated probation practitioner) with a drug/alcohol treatment requirement, the substance misuse/mental health partners will work with the mental health providers ensuring the order is sequenced effectively to address the needs of the individual.
The Authority envisages that there will be four separate lots, and subsequently, four separate contracts for this service for the following Ministry of Justice Police and Crime Commissioner (PCC) regions:
Lot 1 - South Wales
Lot 2 - Gwent
Lot 3 - North Wales
Lot 4 - Dyfed Powys
