Description

The Psychoactive Substances Act 2016 will make it an offence to produce; supply; offer to supply; possess with intent to supply; import or export a psychoactive substance.
A psychoactive substance is defined in Section 2 subsection 1 of the Act as any substance which is capable of producing a psychoactive effect in a person who consumes it, and is not an exempted substance (section 3). Subsection 2 further explains that a substance produces a psychoactive effect in a person if, by stimulating or depressing the person's central nervous system, it affects the person's mental functioning or emotional state.
In order to make provisions to support the Act there is a requirement to conduct in-vitro testing of Test Substances.
