Description
NHS England South West (South) (The Commissioner) is seeking to recommission Domiciliary Dental Services in Exeter, Mid and East Devon and in Torbay. This procurement is being carried out by NHS South, Central and West Commissioning Support Unit (SCW) on behalf of the Commissioners.
Domiciliary Dental care is a service to be provided to patients who are unable to attend or be transported to a Dental surgery due to their medical, mental or physical condition. The population includes both adults and children. Care homes and nursing homes provide a fixed cohort of patients. Beyond the care/nursing home sector, people are directly cared for in their own homes and within a variety of private/social services/local authority run establishments.
The services are expected to deliver high quality and appropriate oral health care to patients who meet the criteria to receive domiciliary care including; a full examination and cancer screening; oral health risk assessment; treatment and oral health care education.
The procurement has been split into two Lots as follows with the corresponding contract values;
Lot 1 - Exeter, Mid and East Devon area (£170,000.00 per annum based on 2019/2020 prices with subsequent years subject to the annual DDRB uplift)
Lot 2 - Torbay area (£170,000.00 per annum based on 2019/2020 prices with subsequent years subject to the annual DDRB uplift)
Bidders may bid for one or both Lots, however, each Lot must be bid for separately and be viable and sustainable in its own right.
The services are anticipated to commence on the 1st April 2019 for contract duration of 4 years until the 31st March 2023 and will be offered under a Personal Dental Services (PDS) Agreement.
Due to the nature of the contract, service delivery cannot be solely measured by Units of Dental Activity (UDAs). Therefore contract delivery will be expected to be achieved within the following parameters:
• 900 - 1300 UDAs per annum
• 400 - 500 FP17s/courses of treatment per annum
• 350 - 400 patients treated per annum
In addition, the following factors will also be taken into account:
• Mileage travelled
• Oral health education provided
• Patients unavailable when visited
TUPE may apply to all Lots.

The services are healthcare services falling within Schedule 3 to the Public Contracts Regulations 2015 ("the Regulations") which are not subject to the full regime of the Regulations, but is instead governed by the "Light Touch Regime" contained within Chapter 3, Section 7 of the Regulations (Regulations 74 to 77).
The tendering process will be conducted in accordance with the requirements and flexibilities provided by Articles 74 to 76 of the Directive, and Regulations 74 to 76 of the Regulations. The Authority will run a transparent tender process, treating all Bidders equally. For the avoidance of doubt, the Authority will not be bound by the Regulations or the Treaty on the Functioning of the European Union or any other regulations or legislation except for the specific parts or circumstances that apply to the procurement of these Services.
Neither the inclusion of a Bidder selection stage, nor the use of any language or terms found in the Directive or Regulations, nor the description of the procedure voluntarily adopted by the Authority ("Open", "Restricted", "Competitive Procedure with Negotiation", "Competitive Dialogue" or any other description), nor any other indication, shall be taken to mean that the Authority intends to hold itself bound by the Directive or Regulations, save by the provisions applicable to services coming within the scope of Annex XIV of the Directive / Schedule 3 of the Regulations.
The Contracting Authority intends to voluntarily observe the award decision notices provisions and 10 day standstill period described in Regulation 86 of the Regulations. Unsuccessful Bidders will receive scores and reasons for the decision, including the characteristics and relative advantages of the winning bid and the reasons why the Bidder/application was unsuccessful. Deadline for lodging of appeals should be in accordance with Regulation 87 and Regulation 91 of the Regulations.
