Justification

The services are healthcare services falling within Schedule 3 to the Public Contracts Regulations 2015 ("the Regulations") which are not subject to the full regime of the Regulations, but is instead governed by the "Light Touch Regime" contained within Chapter 3, Section 7 of the Regulations (Regulations 74 to 77).

The Open procedure timeframe has been reduced from 30 days to 21 days due to circumstances outside of the Commissioners' control.

Description

NHS West Essex Clinical Commissioning Group is seeking a provider for Primary Medical Services at the Nazeing Valley Health Centre, the services are advertised as a Branch Surgery.

The Nazeing Valley Health Centre is situated in the village of Nazeing in the Epping Forest district, Essex, England. The current weighted patient list size is 3085.53 as of 1st October 2017 with a fairly even age distribution in line with the national and CCG's average but slightly less males aged over 75 than the national average.

Services to be provided:

• All Additional Services
• Enhanced Services
• Core opening hours and service delivery from 8am - 6.30pm Monday to Friday (except statutory bank and public holidays)

West Essex CCG is looking for a patient-centred approach to care delivery that is user friendly and culturally sensitive and encompasses national and local public health targets. We are also looking for providers who can demonstrate a willingness to deliver a number of key design principles e.g. improving access and promoting prevention and self-care, as part of core service delivery.

The provider will be needed to provide the full range of primary medical services from 1st June 2018. Following responses to stakeholder engagement the Commissioner will be contracting for the Services using; the NHS General Medical Services (GMS); or the NHS Personal Medical Services (PMS); or the NHS Alternative Provider Medical Services (APMS) contract. The contract form will be dependent on the type of existing contract held by the successful Bidder. Subject to this contract form, the contract period will be an initial 3 years with the option to extend by up to a further 2 years.

Based on current patient list and scope of services the annual contract value is £430k per annum (excluding set-up costs). Any future contract value is expected to be in line with any rise or fall in the patient list size, as may be the case. The total value including all options, set-up costs and possible extensions is £2.2m

Neither the inclusion of a Bidder selection stage, nor the use of any language or terms found in the Directive or Regulations, nor the description of the procedure voluntarily adopted by the Authority ("Open", "Restricted", "Competitive Procedure with Negotiation", "Competitive Dialogue" or any other description), nor any other indication, shall be taken to mean that the Authority intends to hold itself bound by the Directive or Regulations, save by the provisions applicable to services coming within the scope of Annex XIV of the Directive / Schedule 3 of the Regulations.

The Contracting Authority intends to voluntarily observe the award decision notices provisions and 10 day standstill period described in Regulation 86 of the Regulations. Unsuccessful Bidders will receive scores and reasons for the decision, including the characteristics and relative advantages of the winning bid and the reasons why the Bidder/application was unsuccessful. Deadline for lodging of appeals should be in accordance with Regulation 87 and Regulation 91 of the Regulations.
