Description

This tender opportunity is only open to suppliers on the EM Law Share Framework who have already expressed an interest as part of Early Supplier Involvement, and who have been invited to tender.

The Adult Social Care Department within OCC has several debts, consisting of unpaid care contributions, where the debtor has died, and the debt cannot be recovered in the usual way because the estate is unrepresented. It is suspected that the estates are insolvent because there was either misappropriation of the debtors' capital before death or intermeddling with the estates afterwards.

Care was provided to each debtor in accordance with OCC's powers and duties under the Care Act 2014. It is known, by virtue of a financial assessment carried out in accordance with the Act, that each debtor had more than sufficient means to pay his or her assessed contributions. Income Recovery has been tasked with recovering these debts.

It was agreed that the recovery of these debts would be complex, and that the authority would need to seek outside assistance and legal expertise to recover these debts.
